      COMO HOLIDAY WISHING TREE – TERMS & CONDITIONS

      Terms and Conditions 

      1. These terms and conditions (“Terms and Conditions”) shall apply to the COMO HOLIDAY Wishing Tree (Lucky Draw”) organised by COMO Pte Ltd (“COMO”).  

      2. By registering or taking part in this Lucky Draw, you agree to be bound by these Lucky Draw Terms and Conditions and the decisions of COMO in relation to and in connection with this Lucky Draw.  

      Qualifying period 

      3. The COMO HOLIDAY Wishing Tree promotion starts on 24 November 2023, 09:00 and ends on 24 December 2023, 22:00. (“Lucky Draw Period”).  

      4. COMO reserves the right to change the Lucky Draw Period at its sole discretion. 

      Eligibility 

      5. You must be 18 years and above (as of the start of the Lucky Draw Period) to participate in the Lucky Draw (“Participant(s)”). 

      6. The following categories of people are not eligible to participate in the Lucky Draw: 

      i) All permanent and/or contract employees (“Employees”) of the COMO Group of Companies and their immediate family members (spouses, children, parents, brothers and sisters) (“Immediate Family Members”). 

      ii) All agencies and/or service providers engaged by COMO for this Lucky Draw (including but not limited to advertising agencies, PR agencies, creative agencies, printing companies, event management agencies and any persons assisting or who are involved in the Lucky Draw) and their Employees and Immediate Family Members. 

       7. COMO has the absolute discretion to determine the eligibility of Participants. Such determination shall be final and conclusive and COMO is not obliged to give any reason for its determination. 

      Allocation of COMO HOLIDAY Wish Tag (“Lucky Draw Entry Form”)

      8. Participants will be given one (1) Lucky Draw Entry Form with every two (2) receipts obtained at any two (2) different COMO participating outlets, issued between 24 November 2023, 09:00 and 24 December 2023, 22:00. For the full list of COMO participating outlets, refer here.

      9. Only valid Lucky Draw Entry Forms are eligible for participation in the Lucky Draw. 

      10. COMO has absolute discretion to disqualify any Lucky Draw Entry Form that does not meet the criteria set out in these Terms and Conditions. Such determination is final and conclusive and COMO is not obliged to give any reason for its determination. 

      Use of Personal Information 

      11. By participating in the Lucky Draw, the Participants (including the Winners) are deemed to have consented to the collection, use and disclosure of his/her name and contact information by the COMO Group of Companies. As part of compliance requirements, each winner’s full name and the last four digits of the winner’s contact number will be published on the comogroup.com website.  

      General 

      12. The decisions of COMO on all matters relating to or in connection with the Lucky Draw are final, conclusive and binding. COMO shall not be obliged to give any reason or enter any correspondence with any person on any matter concerning the Lucky Draw. 

      13. COMO reserves the right at any time in its sole and absolute discretion to determine and/or amend or vary these terms and conditions without prior notice, including but not limited to cancelling, extending, terminating or suspending this Lucky Draw, the eligibility terms and criteria, the selection and number of winners, and the timing of any act to be done, and all Participants shall be bound by these amendments. 

      14. COMO shall not be responsible for any injury, loss or damage suffered as a result of, or in connection with the Lucky Draw and/or redemption or use of the Prizes howsoever arising, including but not limited to, fulfillment of the prize(s), any error in computing chances, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected and/or lost on the internet, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise. For the avoidance of doubt, cancellation, termination or suspension by COMO of this Lucky Draw shall not entitle any party to any claim or compensation against COMO for any and all losses or damage suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension. 

      15. In the event of any inconsistency between these Terms and Conditions and any advertising, promotional, publicity and other materials relating to or in connection with the Lucky Draw, these Terms and Conditions shall prevail. 

      16. The Lucky Draw and these Terms and Conditions shall be governed by the laws of the Republic of Singapore and all Participants (including the Winners) are deemed to have agreed to submit to the exclusive jurisdiction of the Singapore Courts. 

      Prizes 

      17. Subject to these Terms and Conditions, to be eligible to participate in the Lucky Draw, every Lucky Draw Entry Form is considered valid only when: 

      i) it is submitted together with two (2) receipts obtained from any two different COMO participating outlets during the Lucky Draw Period.

      ii) the submitted receipts have been validated by the COMO representative at any of the three (3) redemption locations —COMO Orchard, COMO Dempsey and VOCO.

      18. With every one (1) Lucky Draw Entry Form, each Participant is eligible for one (1) chance to enter the Lucky Draw to stand an opportunity to receive one of the gifts in The Wishing Tree Gift List (“Prizes”).  

      19. COMO reserves the right to, at any time and in its sole and absolute discretion, replace and/or substitute any of the Prizes with any other item of a similar value.  

      20. There will be twenty-one (21) Lucky Draw winners in total. The winners of the Lucky Draw (“Winners”) will be drawn at random at 6B Orange Grove Road, Singapore 259332 (“COMO House”), after the Lucky Draw qualifying period ends.  

      21. All Winners shall be notified via email, as submitted in the Lucky Draw Entry Form, by 30th December 2023.  

      22. If a Winner fails to produce the required personal identification documents (NRIC or passport), his/her respective Prize will be forfeited (without any liability on the part of COMO to any person). 

      23. Prizes that are not redeemed within thirty (30) calendar days from the date when the notification email was sent will be forfeited. No correspondence or claims will be entertained in the event of such forfeiture. A Participant whose prize has been forfeited shall not be entitled to any payment or compensation whatsoever from COMO. 

      24. Reserve winner(s) will be drawn to replace any winner(s) subsequently disqualified. 

      25. If COMO discovers that a Winner was not entitled to participate or if a Winner is subsequently disqualified from participating in the Lucky Draw, COMO may at its discretion forfeit the Prize, reclaim it and then choose an eventual winner from the reserve winner list or donate the Prize to an approved charitable organisation of COMO’s choice. 

      Prize Redemption and Usage  

      26. Prizes are non-transferable, non-exchangeable for cash, credits or any other item or otherwise, either partially or wholly.  

      27. Any unused value in the Prize will be forfeited. Partial voucher utilisation is not allowed.

      28. Prizes are not valid with other promotions or discounts. Vouchers do not earn Comocredits when used. 

      29. Prize winners are responsible for additional costs not specified as part of the Prize. 

      30. Prize validity cannot be extended.  

      31. Vouchers are verified upon presentation. COMO accepts no responsibility for vouchers lost, stolen or damaged, and such vouchers shall not be refunded or replaced.  

      32. Prize acceptance includes allowing COMO to use the Winner’s name and image for publicity on our website and social media platforms without further compensation or notification. 

      33. COMO reserves the right to amend the terms and conditions on the use of vouchers.  

      Prize by COMO Hotels and Resorts

Includes priority reservations with a personal concierge. 

      • This prize includes dining vouchers worth $1,000, with priority access to reservations with a personal concierge.
      • The prize is valid for six months from 1 January 2024 till 30 June 2024. No extension will be allowed. The prize is applicable for dine-in at Candlenut, Cédric Grolet Singapore, COMO Cuisine, COTE Korean Steakhouse, Ippoh Tempura Bar by Ginza Ippoh, Pangium, The Dempsey Cookhouse and Bar, and Torno Subito Singapore.       • Culina reserves the right to vary the terms and conditions on the prize.  

      Prize by SuperNature

      • A personal concierge will facilitate the booking of this session. Kindly inform the personal concierge at least 7 working days (excluding Saturday, Sunday and PH) in advance to arrange for the session with the in-house Nutritionist and Naturopath.   
      • The voucher is valid for use from 1 January 2024 to 31 March 2024. No extension will be allowed.

      A pair of Category 1 tickets to the hottest concert in town.   

      • Tickets must be fully utilised and cannot be sold in exchange for cash. Como shall not bear responsibility if tickets are cancelled by the organiser due to violation of ticket holder rules by the prize winner.  
      • COMO will be not held responsible should the concert organiser cancel the event due to unforeseen circumstances. 
      • Tickets must be collected in person at a designated COMO establishment. Collection details will be provided to the winner via email after the Lucky Draw has been concluded.  

      Prize by Comoclub  

      Exclusive for Comoclub members: 10 additional winners will each receive 50,000 Comocredits. 

      Eligibility 

      • This Bonus (Bonus Prize) is open to the winners of “COMO Wishing Tree” who are registered members of the Comoclub Recognition Programme (“Comoclub”). (“Eligible Comoclubbers”).
      • To qualify, Eligible Participants must have a registered Comoclub account. 
      • Unregistered Participants will not qualify for the bonus should they be a winner of the “COMO Wishing Tree”. Registration for the Comoclub Recognition Programme can be done at: https://www.comoclub.com/signup, and have to be signed up prior to 24 December, 2023, 2359 hours Singapore time.

      Participation and Personal Data 

      • By participating in this Promotion, Eligible Comoclubbers are subject to these Terms and Conditions. The Eligible Comoclubber shall consent and/or is deemed to have consented, to the collection, use, and disclosure of his/her Personal Data as set out in the clauses below, or as may be set out in any subsequent revised versions of the same:
        • CCPL may disclose the Eligible Cardmember’s Personal Data in accordance with the provisions of the PDPA (including all subsidiary legislation made thereunder), or where otherwise required by law. 
        • The Eligible Comoclubber also agrees that CCPL may use the Personal Data to provide the Eligible Comoclubber with marketing materials relating to COMO Group-related promotions or any services available at any or all of the COMO Group Businesses from time to time (collectively, “Marketing Materials”). CCPL may transfer the Personal Data to the Specified Third Parties for the purpose of providing Marketing Materials to the Eligible Cardmember. CCPL will not disclose the Personal Data to other third parties for marketing by such third parties without the Eligible Comoclubber’s consent. 
        • The Eligible Comoclubber may require CCPL or any of the persons stated in Paragraph (b) not to use the Personal Data for direct marketing purposes, and in such an event, the said Comoclubber will no longer be eligible to participate in the “COMO Wishing Tree” Comoclub Bonus Comocredits. The Eligible Comoclubber may also choose to opt-out of receiving the Marketing Materials after the Promotion Period by writing in to the Comoclub Customer Service at [email protected] during its operating hours – Monday to Fridays, (public holidays excluded), between 9:00am to 6:00pm. The Eligible Comoclubber will cease to receive the Marketing Materials within thirty (30) days after receipt of his/her request to opt out. 

      Other Terms and Conditions 

      • CCPL shall not be responsible or liable for any claim, loss or damage whatsoever or however arising out of or in connection with the Promotion or the Comocredits awarded during the Promotion.
